A & R Check By Phone Terms of Service / Agreement

By using A & R Check by Phone Solutions to process check by phone payments for and on behalf of your company you agree to the following Terms of Service / Agreement:

A & R Check by Phone Solutions is not a bank and is not in the business of banking. here are no monthly fees
A & R Check by Phone Solutions is offering this as a service only.
You understand and agree that all data will be entered by you or an agent of your company. By using the online form you are accepting full legal responsibility for collecting and entering all checking or savings account data from your client/s. Any invalid or missing data is your responsibility and not the responsibility of A & R Check by Phone Solutions.
In collecting and entering data you are certifying that you, or any agent of your company, have the legal right to process a check or demand draft from such client/s.
You understand that A & R Check by Phone Solutions does not guarantee funds on behalf of your client/s. If funds are unavailable when processed through your financial institution it is your sole responsibility to collect from your client/s.
You agree that you have been informed of all charges involved in this service and you are in full agreement with them.
You agree to allow A & R Check by Phone Solutions to make deposits to any bank account you designate, and to verify such accounts in advance, or at any time, as we deem necessary.
You agree to allow A & R Check by Phone Solutions to withdraw its service fees from the checking account, credit card, or debit card you provide. You agree to allow your signature on file to be placed on all fee checks due and payable to A & R Check by Phone Solutions. Fees will be deducted from the same bank account we use for your deposits.
Additionally, a one dollar ($1.00) service fee will be charged if you do not provide an email address, or two dollars ($2.00) if you provide a bad email address, per check processed.
If the service fee is returned unpaid by your financial institution, A & R Check by Phone Solutions charges a thirty five dollar ($35.00) returned item fee. If a second fee is returned unpaid A & R Check by Phone Solutions may place your account on High Risk status. If it is not already on High Risk, A & R Check by Phone Solutions may require that you provide a backup funding source, such as a credit or debit card, to be placed on file.
A & R Check by Phone Solutions does not process ACH transactions. All checks are processed directly to the bank via Image Replacement Document, Demand Draft or Check 21 Image.
A & R Check by Phone Solutions will take every step possible to ensure the validity of each draft you enter into our payment gateway. However, A & R Check by Phone Solutions cannot and does not guarantee funds on any account, and cannot guarantee that once verified the status of any account will not change.
You agree to hold harmless including but not limited to A & R Check by Phone Solutions, its employees, contractors, and agents from any damages arising from any use of this service.
You agree that any and all claims, controversies or disputes arising from or related to our Terms of Service / Agreement, including, but not limited to those claims, controversies or disputes pertaining to the formation, construction, performance, applicability, interpretation, enforceability, or breach of this Agreement, or any claim or assertion that all or part of this Agreement is void or voidable, shall be settled by binding arbitration according to the rules of the American Arbitration Association. Further, venue for the arbitration proceeding shall be in Mecklenburg County, North Carolina. You agree that any award tendered by the arbitrator may be entered as a judgment in the Mecklenburg County Court System and enforceable as an order of said court and you hereby submit to the venue and jurisdiction of that court for purposes of enforcement of any arbitration award.
You agree that the Terms of Service / Agreement may be changed from time to time Without Notice.
